By accessing or using the Guardian Lone Worker platform operated by Corrin Data and Systems ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our service.

2. Description of Service

Guardian Lone Worker is a software platform that facilitates communication between lone workers, their employers, and Alarm Receiving Centres (ARCs). The service includes:

  • Mobile application for lone workers to initiate monitoring sessions
  • Dashboard for employers to view worker status and session history
  • Integration with third-party Alarm Receiving Centres for alert handling
  • Location tracking and check-in functionality

3. Important Disclaimer - Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY.

Guardian Lone Worker acts solely as a communication intermediary between lone workers, employers, and Alarm Receiving Centres. Corrin Data and Systems accepts no liability whatsoever for the safety of lone workers.

You acknowledge and agree that:

  • The service is a communication tool only and does not guarantee worker safety
  • We do not operate or control Alarm Receiving Centres or emergency services
  • Response times and actions taken by ARCs or emergency services are outside our control
  • Technical issues including but not limited to network failures, GPS inaccuracies, device malfunctions, or service outages may affect the service
  • The employer remains solely responsible for the health and safety of their employees
  • This service does not replace proper lone worker risk assessments, training, or other safety measures required by law

4. Exclusion of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy or reliability of location data
  • Warranties that defects will be corrected

5. Limitation of Damages

To the maximum extent permitted by law, Corrin Data and Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of life, loss of profits, data, or other intangible losses, resulting from your use or inability to use the service.

6. User Responsibilities

As a user of Guardian Lone Worker, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Ensure your device meets minimum requirements and has adequate battery and connectivity
  • Not rely solely on this service for lone worker safety
  • Comply with all applicable health and safety legislation
  • Use the service only for its intended purpose

7. Employer Responsibilities

Employers using Guardian Lone Worker acknowledge that:

  • They retain full legal responsibility for employee health and safety
  • This service supplements but does not replace comprehensive lone worker policies
  • They must conduct appropriate risk assessments for lone working activities
  • They are responsible for ensuring workers are properly trained on using the application
  • They must have appropriate arrangements with Alarm Receiving Centres

8. Third-Party Services

Guardian Lone Worker integrates with third-party Alarm Receiving Centres and may use third-party services for mapping and location services. We are not responsible for the actions, policies, or service levels of these third parties. Your use of third-party services is subject to their respective terms and conditions.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice. Scheduled maintenance will be communicated in advance where possible.

10. Indemnification

You agree to indemnify and hold harmless Corrin Data and Systems, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be notified to users via email or through the application. Continued use of the service after changes constitutes acceptance of the updated terms.
